SUSTAINABILITY BOND –  OLDER AND / OR LOWER VALUE BOATS

Changing times and our experience of running Preston Marina since 1990 has required us to introduce the following measure:

At the discretion of the management Preston Marina reserves the right to charge a refundable SUSTAINABILITY BOND in addition to berthing fees for some boats. This may be applied to some older boats (as a guideline 30 years or older) and / or boats of lower value (guideline under £15,000) as a contingency to reduce the potential risk to our Company of the boat in question becoming a financial burden to the Company in future, through neglect or abandonment – and our collective environmental responsibilities.

The sustainability bond will be charged at the commencement of the contract and be held in a separate safe client holding account by our Company, and refunded in full* to the berth-holder we have the contract with when the boat leaves Preston Marina in its entirety at the end of the berthing contract. If the boat becomes abandoned or the berth-holder defaults on berthing fees the sustainability bond may be used towards costs of disposal of the boat after notice is served under Lien and the Torts (Interference Of Goods Act) 1977.

The amount of the sustainability bond will be determined by factors including the size of the boat, the type of boat and the age and condition of the boat.

Upon receiving an application for berthing Preston Marina will reply within 7 working days, with either acceptance and an offer for a berthing contract (including any sustainability bond requirements), or notification that the application has been declined.

 

BOATS THAT BECOME NEGLECTED WHILE AT PRESTON MARINA

If, in the assessment of the management of the Company, a boat is becoming neglected while it is berthed or stored at Preston Marina, a sustainability bond as above will be required at the next offer for renewal of the berthing contract.

The Company reserves the right to increase the value of the sustainability bond at subsequent berthing contract renewals if the boat continues to be neglected and its condition deteriorates further.

The berth-holder can reject any offers to renew berthing contracts, BUT MUST remove the boat in its entirety BY THE END OF THE EXISTING CONTRACT from Preston Marina and any sustainability bond amounts held will be refunded in full*

* PLEASE NOTE BONDS WILL BE REFUNDED IN FULL PROVIDED THERE ARE NO OTHER OUTSTANDING DEBTS WITH THE COMPANY AT THE TIME OF DEPARTURE.
