Brokerage - Terms and Conditions
1. If the Broker introduces a prospective purchaser and a sale is completed to the purchaser, the Owner agrees to pay commission on the final selling price at the rate of 8% + VAT or a minimum of £250 + VAT (lower rates available for boats over £20,000 - please contact us for rates)
2. The Owner undertakes that the vessel will not be offered for sale at a lower asking price and agrees to notify the Broker if the boat is sold or otherwise disposed of and to advise the Broker of the name and address of the Buyer.
3. The Owner shall indemnify the Broker in respect of any claims regarding the sale of the vessel. I understand that the contract of sale is between the Owner and the Purchaser.
4. I agree that if I sell my boat privately I will pay Preston Marina 1% +VAT, if the customer has been in contact with Preston Marina regarding the purchase, a full commission as per item 1 will be due.
5. I understand that my vessel remains entirely at my own risk whilst berthed at Preston Marina and any berthing fees due will be deducted from the proceeds of the sale. I accept that my boat may be lifted and surveyed.
6. In the event that a vessel is accepted for brokerage and she is berthed elsewhere, then the terms of the agreement remain the same.
BROKERAGE ARRANGEMENTS
ADMINISTRATION FEE
An administration fee of £50 will be made and must be paid for upon signing the 'Brokerage Agreement & Arrangements' form. This is refundable upon completion of the sale, and payment of full commission as agreed in clause 1
BERTHING
AFLOAT/YARD
The seller will be charged storage for the period of time that the boat is on brokerage. A 'Brokerage Berthing Advice' note will be issued from the date the vessel is placed on brokerage; the rate charged will be based on the 12 months berthing rate. The storage charge will be calculated pro-rata to the date that the sale of the boat is completed and will be deducted from the sale proceeds.
Should the boat remain unsold at the end of the year then the seller will be issued with an invoice equivalent to the amount advised in the 'Brokerage Berthing Advice' note, this must be settled within one month. The Broker reserves the right, after the vessel has been on brokerage for 12 months, to remove the boat from brokerage. If the vessel is removed from brokerage and remains at the marina a berthing invoice will be issued in accordance with the owners instructions or the vessel should be removed from the marina. If the vessel remains on brokerage a 'Brokerage Berthing Advice' note will be issued for another twelve months.
As of June 2008, Preston Marine Services Ltd. will only agree to handle brokerage sales for boats berthed at Preston Marina, and will no longer be offering brokerage services to boats at other locations.

SAILING BOATS WITH OWN ROAD TRAILER
Sailing Boats under 24' (7.3m) which are on a proper and UK road-worthy trailer will be accepted for brokerage for a period of six months with no storage charge. Should the boat remain unsold at the end of this 'free' period then the owner will have the choice of removing the boat from brokerage and the premises or leaving the boat on brokerage and being charged berthing for the period of time the vessel spends on brokerage during the next six months. Other craft may be considered for this arrangement exclusively at the discretion of Preston Marine Services Ltd.
Should the seller decide to keep the boat on brokerage a 'Brokerage Berthing Advice' note will be issued for the next 6 months. A special rate, based on the 12 months berthing rate, will be advised. The storage charge will be calculated pro-rata from the end of the 'free' period to the date that the sale of the boat is completed and will be deducted from the sale proceeds.
Should the boat remain unsold at the end of the second 6 month period then the boat will be removed from brokerage and the seller will be issued with an invoice equivalent to the amount advised in the 'Brokerage Berthing Advice' note. The owner will be asked to remove the boat from the premises upon payment of this invoice and within one month of the invoice date.
HUSBANDRY
All vessels placed on brokerage must be in clean & tidy condition. Should the vessel be in a standard of condition, which in the opinion of the Broker, is unsuitable for placing on brokerage, then the Broker can arrange, on the instructions of the seller, an initial clean for which a charge will be made subject to discussion.
In order for vessels to remain in a condition suitable for brokerage they will require regular attention. This should be carried out at regular intervals by the seller e.g. monthly or on the instructions of the seller, husbandry can be arranged by the Broker, on a monthly basis, for which a charge will be made subject to discussion.
